2. Guest Responsibility
This Agreement applies to all members of the Guest’s party, regardless of age or affiliation (“the Group”).
The Primary Guest agrees to:
- Share this Agreement and all requirements with every member of the Group.
- Ensure full compliance with all rental terms and property rules.
In consideration of the rent received, the Owner of the Rental Property leases the Property to Guest(s) under the following terms and conditions.
3. General Rules & Property Use
- Guest agrees to follow all rules and regulations listed herein or posted at the property.
- Guest must keep the premises clean and safe and cause no unsafe or unsanitary conditions.
- The property may not be used for any commercial, illegal, or disruptive activities.
- Violation of any rule shall be considered a material breach, resulting in termination of occupancy without refund.
4. Occupancy Limits & Access
- The property must not exceed the maximum occupancy stated on the website or confirmation letter.
- Fraternity, school, or non-family groups are prohibited unless approved by the Owner.
- The property may not be sublet or reassigned without written consent.
- Violation of this rule is grounds for immediate eviction without refund.
- Owner reserves the right to enter the property at any time for inspection, maintenance, or repair.
- If the property is listed for sale, Guest agrees to allow access by appointment with notice.
5. Security Hold or Damage Waiver
A security hold or damage waiver is required.
- If the security hold is chosen, it will be released in full after checkout if no damage is found.
- If damage occurs, the Owner will provide a detailed report, and the card on file will be charged.
- If damages exceed $3,000, the Guest agrees to pay the balance within 5 business days of notification.
Possible charges include:
- Excess cleaning or trash removal fees
- Hot tub draining/refilling
- Missing or damaged items
- Property or equipment repairs
Owner is not obligated to use the least expensive method of repair or replacement.
6. Pets & Children
- Pets are only allowed with prior written approval from the Owner.
- Unauthorized pets are grounds for immediate eviction without refund.
- Guests must inform the Owner of all children under 18 staying at the property.
7. Refunds & Service Interruptions
No refunds will be given for:
- Appliance or amenity malfunctions (pools, hot tubs, elevators, etc.)
- Power outages, water shortages, flooding, construction, or weather events
- Mandatory evacuations or other natural disasters (“Acts of God”)
The Owner will make every reasonable effort to ensure all amenities are functional.
8. Telephone & Communication
If a landline phone is available:
- It may be restricted to local calls only.
- Guests may need to use a calling card for long-distance calls.
- Unless explicitly listed, long-distance calls are not complimentary.
9. Lost & Found
- Guests are responsible for shipping costs if requesting return of lost items.
- Unclaimed items after 30 days will be discarded at the Owner’s discretion.
10. Pools, Hot Tubs & Outdoor Equipment
- Pools/hot tubs are maintained and tested before check-in.
- Guests may incur a service charge for misuse (soap, oil, glass, etc.).
- Pets are strictly prohibited from pools or hot tubs — violation results in eviction without refund.
The property may also include access to recreational or water activities (canoes, bicycles, etc.), which Guests use at their own risk.
11. Linens & Towels
Guests are responsible for any lost or damaged linens or towels, billed at twice the standard rental price.
12. Property Unavailability
If the Owner cannot make the property available for any reason, a full refund will be issued.
The Owner shall not be liable for special or consequential damages arising from unavailability.
13. Indemnification & Liability
Guest agrees to indemnify and hold harmless the Owner and their agents, employees, or contractors from all injury or damage claims, including but not limited to:
- Accidents, negligence, or natural events
- Injuries from use of facilities (pools, hot tubs, gym equipment, etc.)
Guest assumes all responsibility for themselves and their group during their stay.
14. Termination
The Owner may terminate this Agreement immediately upon any breach of its terms.
In such cases, the Guest must vacate the property, and no refund will be issued.
15. Governing Law
This Agreement is governed by the laws of the state where the property is located.
Legal action may only be filed in the county of the property’s location.
If any clause of this Agreement is deemed unenforceable, the remainder shall remain valid.
16. Assumption of Risk & Guest Acknowledgment
By signing this Agreement, Guest acknowledges and accepts:
- Full responsibility for their safety and the safety of their group.
- Awareness that outdoor and water activities involve inherent risks (injury, illness, or death).
- That alcohol and drugs should not be mixed with outdoor activities.
Guest agrees to:
- Return the property in the same condition as received.
- Accept liability for all damages and losses during their stay.
- Hold the Owner harmless from all injury or property damage claims.
- Comply with all federal, state, and county laws, including pollution and safety regulations.
17. Acceptance of Terms
I, the undersigned Guest, have read and understood all rules, policies, and conditions outlined in this Agreement.
I accept full responsibility for myself, my group, and any visitors during the rental period.
